Mary W. Bourke is a Partner in the firm's Intellectual Property Group. She represents clients in patent litigation related to biotechnology and pharmaceutical matters.

Mary has over 20 years of patent litigation experience at both the district court and appellate levels. She has been involved in multiple ANDA litigations and is knowledgeable about the complexities of litigation under the Hatch-Waxman Act.

She was the co-first chair for Pfizer’s successful defense of Lipitor® against an ANDA challenge by Ranbaxy, and she currently represents Pfizer in follow-on ANDA challenges to Lipitor® and a new ANDA to Pfizer’s Caduet®. Additionally, Mary currently represents Ortho-McNeil in an ANDA case against Par Pharmaceuticals involving Ultram® ER and represents Astra Zeneca in seven ANDA challenges to Crestor®.

Mary also successfully led the litigation team for Bayer in the successful lawsuits against Housey Pharmacuticals involving cell-based screening methods. She is presently involved in the firm’s representation of Lifescan Inc. involving glucose monitoring systems. Mary has participated in all phases of the firm’s litigation practice including pretrial, trial and appellate stages of litigation, both domestically and internationally.
